Getting Legal Advice
You wouldn’t consider buying a property in your home country without the advice of a good lawyer who knows exactly what to look for and how to resolve issues so there is even more reason to engage the help of an independent legal professional when you are buying a property in a place where you are unfamiliar with the laws and the local ways.
Unbelievably some people do try to cut corners and do it themselves and then are surprised to find that they have made some monumental mistakes along the way.
It is really important to work with someone that you know and trust in order to ensure that all procedures have been carried out correctly. You should make sure that it is someone you feel comfortable with and speaks your language so as you can clearly understand exactly what your position is in relation to the contract and the supporting documentation.
It is especially important here in Spain to ensure that you do not complete on a property with outstanding debts attached to it. Items such as the previous owner’s mortgage costs, community fees, state or municipal taxes or any other unpaid bills remain connected to the property and in the event of being unsettled at the time of purchase go on to become the responsibility of the new owner. A good lawyer will ensure that there are no outstanding debts attached so as you can go ahead and complete on your new home free and clear of any inherited liabilities.
You should be clearly informed of exactly what the completion costs will be at the outset so as you don’t get any unwelcome surprises further down the line. The buying costs include items such as sales tax, Notary fees, property registry fees and legal fees, plus if you are taking out a mortgage here in Spain there will be fees relating to that as well.
